Terms and Conditions

Last updated: 21 July 2026

§ 1 Scope

These terms and conditions apply to all contracts between ERA BY NAZ, owner Nazanin Fathi (the seller), and her customers, in the version valid at the time the order is placed.

A consumer within the meaning of these terms is any natural person who enters into a legal transaction for purposes which are predominantly outside their trade, business or profession. A trader is any natural or legal person acting in the course of their trade, business or profession.

§ 2 Formation of contract

The presentation of products on the website does not constitute a legally binding offer, but an invitation to place an order. By placing an order you make a binding offer. The contract is formed when we accept it, either by a separate declaration of acceptance or by dispatching the goods.

§ 3 Wholesale and pre-orders

The following applies in addition to trade buyers with approved wholesale access. An order placed through the wholesale area is an order request. It does not constitute a contract and does not trigger any payment. A contract is formed only when we confirm the request in text form.

Production follows a pre-order model. Binding delivery dates are stated in the order confirmation. Minimum order quantities and payment terms are agreed individually.

§ 4 Prices and payment

All prices quoted to consumers are final prices and include statutory VAT. Prices quoted to trade buyers are net prices exclusive of VAT.

Prices are shown in euro, US dollars or pounds sterling depending on the buyer’s country. Each price is set separately by us; it is not the result of an automatic currency conversion, and the price displayed is the price that applies.

Payment is made using the payment methods offered during the ordering process. For wholesale order requests, payment is agreed separately after confirmation.

§ 5 Delivery

Delivery is made to the address given by the buyer. Details of shipping costs and delivery times can be found under Shipping & Returns.

§ 6 Retention of title

The goods remain the property of the seller until payment has been made in full.

§ 7 Right of withdrawal

Consumers have a statutory right of withdrawal. Details are set out in our Right of Withdrawal notice. There is no statutory right of withdrawal for traders.

§ 8 Warranty

The statutory warranty rights apply. In relation to traders, the limitation period for warranty claims for new goods is one year from delivery.

§ 9 Liability

The seller is liable without limitation for intent and gross negligence, and for injury to life, body or health. In the case of slight negligence, the seller is liable only for breach of a material contractual obligation, and then limited to the foreseeable damage typical of the contract.

§ 10 Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final provisions

The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only to the extent that it does not remove the protection of mandatory provisions of the law of the country in which the consumer has their habitual residence.

Should individual provisions be invalid, the validity of the remaining provisions is unaffected.
